Use of the website AnaLesnaya.com

The use of the website AnaLesnaya.com, as well as the booking of photo shoots, is permitted exclusively to persons who are at least 18 years of age. By checking the corresponding confirmation box, the customer bindingly declares:
"I confirm that I am at least 18 years old and legally entitled to act."
This declaration is an integral part of the conclusion of the contract.

The German version of this document is the legally binding version. The English translation is provided for convenience and information purposes only.

1. Principle

Photoshoots and services provided by the photographer are exclusively available to individuals who have reached the minimum age specified for the respective category. This policy serves to protect minors, ensure compliance with legal regulations, and maintain safety during the photoshoot.

2. Age Groups

2.1 Adults (18 years and older)

Bookings, use of the website, conclusion of contracts, and participation in shoots are only permitted for persons aged 18 and over.
The customer confirms their age in a legally binding manner.
False information shall lead to full liability for costs, damages, and any legal fees.
Proof of age may be requested at any time; refusal shall result in the cancellation of the appointment without refund.
Accepted forms of identification: ID card, passport, driver's license.
For online or digital shoots, the photographer reserves the right to request additional digital age verification (e.g., by presenting an ID to the camera) if necessary.
The use of photos for commercial purposes, social media, or portfolios is only permitted with the written consent of the photographer.
The storage and processing of photos are subject to the GDPR (DSGVO); customers confirm their consent.

2.2 Minors (5–17 years)

Shoots are only permitted under the following conditions:

Legal Guardians:

Presence of a parent or legal guardian during the shoot is mandatory.
Written consent of the parents/guardians (also accepted in digital form).

Safety Rules:

All safety and conduct rules must be strictly observed.
Risky poses (e.g., balancing, jumps, upside-down poses, extreme stretching) are prohibited.
Sexualized, erotic, or inappropriate poses are strictly forbidden.

Liability:

The legal guardian assumes statutory liability for damages caused by the child (§ 832 BGB - German Civil Code).
The photographer is only liable in cases of gross negligence or intent; mandatory legal liability for injury to life, body, or health remains unaffected.
The legal guardian is also liable for all damage to the photographer's property (equipment, props, studio items) caused by the child or accompanying persons. The presence of additional accompanying persons (other than one legal guardian) is only permitted after prior written consultation with the photographer.
Right of Termination:
The photographer may terminate the shoot at any time if the child is endangered or safety rules are not followed.
Payments already made must be settled in full, provided there is no culpable breach by the photographer.
Non-appearance (no-show) without prior notice will result in the full charging of the agreed fees.
Documentation:
Legal guardians must confirm all required consents in writing, including the Model Release and acknowledgment of prohibited poses.
Online or Digital Shoots:
Written consent from the parents/guardians and age verification must also be provided.
GDPR-compliant data processing and storage of the photos are guaranteed.

2.3 Children under 5 years
Shoots are only possible following an individual safety assessment and approval by the photographer.
Parents must fully disclose relevant health information and behavioral assessments.
The photographer may refuse the shoot if safety risks exist or the necessary conditions cannot be guaranteed.

3. General Safety and Conduct Rules

Not Allowed / Prohibited Poses:

Nude, erotic, or sexualized poses.
Dangerous or inappropriate body postures, including:
Upside-down poses.
Balancing on edges, furniture, or unstable surfaces.
Extreme jumps, stretches, or support positions with high stress on joints/spine.
Poses that violate legal regulations for minors.

Duty of Supervision:

Parents/legal guardians must exercise their duty of supervision at all times.
The photographer is entitled to request additional security measures at any time (e.g., presentation of identification).

Health:

Parents confirm that there are no health restrictions (back, joints, circulation, balance) that could endanger the photoshoot.

Emergency Measures:

In the event of a medical emergency during the shoot, the photographer will immediately inform the legal guardian and act in accordance with generally recognized first-aid measures.
Parents/legal guardians must have their contact details and an emergency number ready.

The definition and assessment of whether a pose is to be classified as "sexualized," "erotic," or "inappropriate" is, in case of doubt, subject exclusively to the professional and artistic discretion of the photographer.

4. Documentation and Consents

For minors, the following documents must be provided:

Proof of identity of the legal guardian.
Written consent for the photographic representation.
Consent for data processing in accordance with the GDPR (DSGVO).
Acknowledgment of prohibited and risky poses.
Confirmation of the duty of supervision and liability (§ 832 BGB).
For digital or online shoots: additional confirmation of digital age verification.

Without these documents, no contract will be concluded, and the photoshoot may not be performed.

In the case of online or digital photoshoots, the photographer may require the legal guardian to briefly hold the identity documents (their own as well as those of the child) up to the camera at the beginning of the session, provided this is necessary for beyond-doubt age verification.

5. Termination and Cancellation Rights

In the event of violations of the Age Policy or safety requirements, the photoshoot may be terminated immediately.
Services already rendered must be paid in full, provided there is no culpable breach of duty by the photographer.
Non-appearance (no-show) of a minor model without prior notice will result in the full charging of the agreed fees.
Changes due to weather, studio conditions, or medical emergencies of the photographer are reserved; the customer agrees to short-term adjustments.

6. Information on Booking and Communication

Parents/legal guardians must assume full responsibility for bookings, instructions, and participation.
Communication regarding appointments, changes, or safety instructions shall take place exclusively with the legal guardians.
Use of the photos for commercial purposes, portfolios, or social media is only permitted with written consent.

1. Grundsatz

Fotoshootings und Dienstleistungen der Fotografin stehen ausschließlich Personen offen, die das in der jeweiligen Kategorie festgelegte Mindestalter erreicht haben.

Diese Richtlinie dient dem Schutz von Minderjährigen, der Einhaltung gesetzlicher Vorschriften und der Sicherheit während des Shootings.

2. Altersgruppen

2.1 Erwachsene (18 Jahre und älter)

Buchungen, Nutzung der Website, Vertragsabschluss und Teilnahme an Shootings nur für Personen ab 18 Jahren.
Der Kunde bestätigt sein Alter rechtsverbindlich.
Falschangaben führen zur vollen Haftung für Kosten, Schadensersatz und eventuelle Rechtskosten.
Altersnachweis kann jederzeit verlangt werden; Verweigerung führt zur Stornierung des Termins ohne Erstattung.
Akzeptierte Altersnachweise: Personalausweis, Reisepass, Führerschein.
Für Online- oder digitale Shootings behält sich die Fotografin das Recht vor, im Bedarfsfall eine zusätzliche digitale Altersverifikation (z. B. durch Vorzeigen des Ausweises in die Kamera) zu verlangen.
Die Nutzung der Fotos für kommerzielle Zwecke, Social Media oder Portfolio erfolgt nur mit schriftlicher Zustimmung der Fotografin.
Speicherung und Verarbeitung der Fotos unterliegt DSGVO; Kunden bestätigen ihr Einverständnis.

2.2 Minderjährige (5–17 Jahre)

Shootings sind nur unter folgenden Bedingungen zulässig:

Erziehungsberechtigte:

Anwesenheit eines Elternteils oder gesetzlichen Vormunds während des Shootings.
Schriftliche Einwilligung der Eltern/Vormund (auch digital akzeptiert).

Sicherheitsregeln:

Alle Sicherheits- und Verhaltensregeln müssen strikt eingehalten werden.
Riskante Posen (z. B. Balancieren, Sprünge, Kopf-über-Posen, extreme Dehnungen) sind verboten.
Sexualisierte, erotische oder unangemessene Posen sind streng untersagt.

Haftung:

Der Erziehungsberechtigte übernimmt die gesetzliche Haftung für Schäden, die durch das Kind entstehen (§ 832 BGB).
Die Fotografin haftet nur bei grober Fahrlässigkeit oder Vorsatz; gesetzlich zwingende Haftung für Verletzungen von Leben, Körper oder Gesundheit bleibt bestehen.
Der Erziehungsberechtigte haftet zudem für sämtliche Schäden am Eigentum der Fotografin (Equipment, Requisiten, Studiogegenstände), die durch das Kind oder Begleitpersonen verursacht werden. Die Anwesenheit von weiteren Begleitpersonen (außer einem Erziehungsberechtigten) ist nur nach vorheriger schriftlicher Absprache mit der Fotografin gestattet.

Abbruchrecht:

Die Fotografin kann das Shooting jederzeit abbrechen, wenn das Kind gefährdet wird oder Sicherheitsregeln nicht eingehalten werden.
Bereits geleistete Zahlungen sind voll zu leisten, sofern keine schuldhafte Verletzung der Fotografin vorliegt.
Nichterscheinen ohne vorherige Absprache führt zur vollen Berechnung der vereinbarten Gebühren.

Dokumentation:

Erziehungsberechtigte müssen alle erforderlichen Einwilligungen schriftlich bestätigen, einschließlich Model Release und Kenntnisnahme verbotener Posen.

Online- oder digitale Shootings:

Auch hier muss eine schriftliche Einwilligung der Eltern/Vormund und Altersverifikation vorliegen.
DSGVO-konforme Datenverarbeitung und Speicherung der Fotos wird gewährleistet.

2.3 Kinder unter 5 Jahren

Shootings nur nach individueller Sicherheitsbewertung und Freigabe durch die Fotografin.
Eltern müssen relevante gesundheitliche Informationen und Verhaltenseinschätzungen vollständig mitteilen.

Die Fotografin kann das Shooting ablehnen, wenn Sicherheitsrisiken bestehen oder die Bedingungen nicht gewährleistet sind.

3. Allgemeine Sicherheits- und Verhaltensregeln

Nicht erlaubt / Verbotene Posen:

Nackt-, Erotik- oder sexualisierte Posen,
Gefährliche oder unangemessene Körperhaltungen, darunter:
- Kopfüber-Posen,
- Balancieren auf Kanten, Möbeln oder instabilen Oberflächen,
- Extreme Sprünge, Dehnungen oder Stützpositionen mit hoher Belastung auf Gelenke/Wirbelsäule,
- Posen, die gegen gesetzliche Vorschriften für Minderjährige verstoßen.

Aufsichtspflicht:

Eltern/Erziehungsberechtigte müssen jederzeit die Aufsichtspflicht wahrnehmen.
Die Fotografin ist berechtigt, jederzeit zusätzliche Sicherheitsmaßnahmen zu verlangen (z. B. Ausweisvorlage).

Gesundheit:

Eltern bestätigen, dass keine gesundheitlichen Einschränkungen (Rücken, Gelenke, Kreislauf, Gleichgewicht) bestehen, die das Shooting gefährden könnten.

Notfallmaßnahmen:

Im Falle eines medizinischen Notfalls während des Shootings informiert die Fotografin sofort den Erziehungsberechtigten und handelt nach den allgemein anerkannten Erste-Hilfe-Maßnahmen.
Eltern/Erziehungsberechtigte müssen ihre Kontaktdaten und eine Notfallnummer bereithalten.

Die Definition und Beurteilung, ob eine Pose als „sexualisiert“, „erotisch“ oder „unangemessen“ einzustufen ist, unterliegt im Zweifelsfall ausschließlich dem fachlichen und künstlerischen Ermessen der Fotografin.

4. Dokumentation und Einwilligungen

Für Minderjährige müssen folgende Dokumente vorliegen:

Identität des Erziehungsberechtigten
Schriftliche Einwilligung zur fotografischen Abbildung
Einwilligung zur Datenverarbeitung nach DSGVO
Kenntnisnahme der verbotenen und riskanten Posen
Bestätigung der Aufsichtspflicht und Haftung (§ 832 BGB)
Für digitale oder Online-Shootings: zusätzliche Bestätigung der digitalen Altersverifikation

Ohne diese Dokumente wird kein Vertrag abgeschlossen, und das Shooting darf nicht durchgeführt werden.

Bei Online- oder digitalen Shootings kann die Fotografin verlangen, dass der Erziehungsberechtigte zu Beginn der Sitzung die Identitätsdokumente (eigene sowie die des Kindes) kurz in die Kamera hält, sofern dies zur zweifelsfreien Altersverifikation erforderlich ist.

5. Abbruch- und Stornierungsrechte

Bei Verstößen gegen die Altersrichtlinie oder Sicherheitsvorgaben kann das Shooting sofort abgebrochen werden.
Bereits erbrachte Leistungen sind voll zu bezahlen, sofern keine schuldhafte Verletzung der Fotografin vorliegt.
Nichterscheinen eines minderjährigen Models ohne vorherige Absprache führt zur vollen Berechnung der vereinbarten Gebühren.
Änderungen aufgrund von Wetter, Studiobedingungen oder gesundheitlichen Notfällen der Fotografin sind vorbehalten; der Kunde stimmt kurzfristigen Anpassungen zu.

6. Hinweise für Buchung und Kommunikation

Eltern/Erziehungsberechtigte müssen die volle Verantwortung für Buchungen, Anweisungen und Teilnahme übernehmen.
Kommunikation über Termine, Änderungen oder Sicherheitsanweisungen erfolgt ausschließlich mit den Erziehungsberechtigten.
Nutzung der Fotos erfolgt nur mit schriftlicher Zustimmung für kommerzielle Zwecke, Portfolio oder Social Media.
