Child Photoshoot – Special Provisions (Kindershooting – Besondere Bestimmungen)

1. General Principle
1.1.
Photoshoots with children under 5 years of age are not part of the photographer's regular service offerings.
1.2.
The conducting of a child photoshoot is only possible in exceptional cases and exclusively after individual review, written agreement via email, and express confirmation by the photographer.
1.3.
Without written commitment via email, no photoshoots with children under 5 years of age will be booked or conducted.
1.4.
Photoshoots with children and adolescents aged 5 and older are available as part of the regular services. However, for all minors (under 18 years of age), the parents' duty of supervision pursuant to Section 2.2 of these provisions applies without restriction.
2. Safety and Duty of Supervision
2.1.
The safety of the child has the highest priority.
2.2.
During the entire photoshoot, a parent or a legal representative must be present continuously and bears the full duty of supervision (Aufsichtspflicht).
2.3.
The photographer assumes no responsibility for injuries, accidents, or damages arising due to a lack of supervision by the parents/legal guardians.
2.4.
Dangerous or risky poses, unsafe props, or situations that constitute a safety risk will not be performed — regardless of customer requests.
2.5.
The photographer is entitled to interrupt or terminate the photoshoot at any time if safety conditions are not complied with.
3. Health, Behavior, and Special Needs
3.1.
Parents must provide all relevant information regarding the child's health status, any special characteristics, or behavioral traits in writing via email in advance.
3.2.
In the event of illness, fever, contagious infections, or other health risks, the photoshoot may be postponed or canceled.
3.3.
If the child shows signs of stress, anxiety, or clear overwhelm during the photoshoot, the photographer may adjust the setup or terminate the shoot.
3.4.
Parents are obligated to bring their own hygiene items, clothing, spare laundry, and personal items for the child.
4. Equipment, Clothing, and Props
4.1.
The photographer provides exclusively safe and age-appropriate props.
4.2.
Parents assume full responsibility for props, clothing, or accessories brought to the shoot.
4.3.
Unsuitable, unsafe, or unhygienic items may not be used.
4.4.
The photographer has the final decision-making authority regarding the suitability of all props used.
5. Parental Conduct during the Photoshoot
5.1.
Parents may support the child but may not actively interfere with the photographic design.
5.2.
Independent photography or filming, especially with a flash, is prohibited during the photoshoot.
5.3.
Conduct or interventions by the parents that disrupt the process, compromise safety, or influence the photographer's artistic style may lead to adjustments or to the termination of the shoot.
6. Parents' Duty of Cooperation
6.1.
Parents must ensure that the child is well-rested, fed, and ready for the photoshoot.
6.2.
A lack of preparation may reduce the effective shooting time.
6.3.
In the event of delays of more than 20 minutes, a surcharge may be charged or the shooting time may be shortened accordingly.
7. Image Selection, Delivery Deadlines, and Processing
7.1.
Within 7 days after the photoshoot, the photographer will provide a pre-selection gallery (“Online Gallery”) with lightly corrected images (basic light and color adjustment).
7.2.
The final retouching begins only after the parents have submitted their image selection exclusively via email.
7.3.
The standard processing time is 7–14 days from the receipt of the image selection via email.
7.4.
If additional retouches are ordered after the completion of the main assignment, the processing time may be extended to up to 21 days.
7.5.
RAW files will fundamentally not be released.
8. Deadlines for Image Selection
8.1.
The parents are obligated to communicate the final image selection via email within 7–14 calendar days after the provision of the online gallery. The specific deadline is determined by the contract or the offer.
8.2.
If no feedback is received within the deadline, the photographer may: – archive the gallery and pause the processing, or – send an email reminder and grant an additional grace period of 3 days.
8.3.
If no selection is made even after that, a reactivation of the gallery or the continuation of processing can only take place against an administrative fee (€20–50, depending on the effort).
8.4.
Delays caused by the parents extend all delivery deadlines accordingly; the originally agreed delivery times lose their validity.
9. Copyright, Usage Rights, and Publication
9.1.
The copyright to all images remains entirely with the photographer.
9.2.
Parents receive exclusively the usage rights that are expressly established in the respective contract.
9.3.
Any further use, modification, filtering, processing by AI, distribution, sale, NFT creation, or commercial use is prohibited without written permission via email.
9.4.
Publications on social media, in chats, or similar platforms are only permitted within the contractually granted usage rights.
9.5.
Use by third parties or for promotional purposes is strictly prohibited without written consent.
10. Data Protection and Personal Rights of the Child
10.1.
The processing of personal data is carried out in accordance with the GDPR (DSGVO).
10.2.
Images of children will never be published without the prior written consent of the legal guardians.
10.3.
Parents can receive information about stored data or request its deletion at any time, provided that there are no statutory retention obligations to the contrary.
11. Cancellation, Rescheduling, and Termination
11.1.
Any cancellation or change of appointment must be made in writing via email.
11.2.
In the event of the child's illness, the appointment may be rescheduled once free of charge.
11.3.
In the event of multiple reschedulings or short-term cancellations (less than 48 hours notice), fees may apply in accordance with the general cancellation terms.
11.4.
The photographer may terminate the photoshoot if safety, behavioral, or contractual rules are violated. Costs already incurred shall be borne by the customer.
12. Ethical Boundaries of AI Processing for Minor Models

Protection of Anatomical Integrity: When processing photographic materials depicting minors (under the age of 18), the Photographer commits to maintaining anatomical immutability. Any generative alteration of natural body proportions, facial features, or the artificial depiction of secondary sexual characteristics is strictly prohibited.

Permitted Artistic Stylization: This prohibition does not extend to decorative and conceptual elements that leave the model's anatomical authenticity unaffected. Specifically, the following AI-supported adjustments are permissible within the framework of the agreed-upon "Legend":

Hair: Modification of color and length, as well as the addition of fantasy hairstyles or luminous effects.

Clothing and Costumes: Addition of details (e.g., armor elements, embroidery), changing fabric color, or adding magical attributes.

Environment and Effects: Full or partial background replacement, the addition of fairytale flora and fauna (mythical creatures), and atmospheric effects (light, fog, magic).

Cosmetic Effects: Digital fantasy make-up or alteration of eye color, provided it serves the artistic concept.

1. Allgemeiner Grundsatz
1.1.
Fotoshootings mit Kindern unter 5 Jahren gehören nicht zum regulären Leistungsangebot der Fotografin.
1.2.
Die Durchführung eines Kindershootings ist nur in Ausnahmefällen und ausschließlich nach individueller Prüfung, schriftlicher Vereinbarung per E-Mail und ausdrücklicher Bestätigung der Fotografin möglich.
1.3.
Ohne schriftliche Zusage per E-Mail werden keine Shootings mit Kindern unter 5 Jahren gebucht oder durchgeführt.
1.4.
Fotoshootings mit Kindern und Jugendlichen ab 5 Jahren sind regulär möglich. Für alle Minderjährigen (unter 18 Jahren) gilt jedoch uneingeschränkt die Aufsichtspflicht der Eltern gemäß Punkt 2.2 dieser Bestimmungen.
2. Sicherheit und Aufsichtspflicht
2.1.
Die Sicherheit des Kindes hat höchste Priorität.
2.2.
Während des gesamten Shootings muss ein Elternteil oder eine gesetzliche Vertretung ununterbrochen anwesend sein und trägt die vollständige Aufsichtspflicht.
2.3.
Die Fotografin übernimmt keine Verantwortung für Verletzungen, Unfälle oder Schäden, die aufgrund mangelnder Aufsicht der Eltern/Erziehungsberechtigten entstehen.
2.4.
Gefährliche oder riskante Posen, unsichere Requisiten oder Situationen, die ein Sicherheitsrisiko darstellen, werden nicht durchgeführt – unabhängig von Kundenwünschen.
2.5.
Die Fotografin ist berechtigt, das Shooting jederzeit zu unterbrechen oder abzubrechen, wenn Sicherheitsbedingungen nicht eingehalten werden.
3. Gesundheit, Verhalten und besondere Bedürfnisse
3.1.
Eltern müssen vorab alle relevanten Informationen zum Gesundheitszustand, eventuellen Besonderheiten oder Verhaltensmerkmalen des Kindes schriftlich per E-Mail mitteilen.
3.2.
Bei Krankheiten, Fieber, ansteckenden Infektionen oder sonstigen gesundheitlichen Risiken kann das Shooting verschoben oder abgesagt werden.
3.3.
Zeigt das Child während des Shootings Stress, Angst oder deutliche Überforderung, kann die Fotografin das Setup anpassen oder das Shooting abbrechen.
3.4.
Eltern sind verpflichtet, eigene Hygieneartikel, Kleidung, Ersatzwäsche und persönliche Gegenstände des Kindes mitzubringen.
4. Ausstattung, Kleidung und Requisiten
4.1.
Die Fotografin stellt ausschließlich sichere und altersgerechte Requisiten zur Verfügung.
4.2.
Für mitgebrachte Requisiten, Kleidung oder Accessoires übernehmen die Eltern die volle Verantwortung.
4.3.
Ungeeignete, unsichere oder unhygienische Gegenstände dürfen nicht verwendet werden.
4.4.
Die Fotografin entscheidet letztinstanzlich über die Eignung aller eingesetzten Requisiten.
5. Verhalten der Eltern während des Shootings
5.1.
Eltern dürfen das Kind unterstützen, jedoch nicht aktiv in die fotografische Gestaltung eingreifen.
5.2.
Eigenständiges Fotografieren oder Filmen, insbesondere mit Blitz, ist während des Shootings untersagt.
5.3.
Verhalten oder Eingriffe der Eltern, die den Ablauf stören, die Sicherheit beeinträchtigen oder den fotografischen Stil der Fotografin beeinflussen, können zu Anpassungen oder zum Abbruch führen.
6. Mitwirkungspflichten der Eltern
6.1.
Eltern müssen sicherstellen, dass das Kind ausgeruht, satt und aufnahmebereit ist.
6.2.
Mangelnde Vorbereitung kann die effektive Shooting-Zeit reduzieren.
6.3.
Bei Verzögerungen von mehr als 20 Minuten kann ein Aufpreis berechnet oder die Shooting-Zeit entsprechend verkürzt werden.
7. Auswahl der Bilder, Lieferfristen und Bearbeitung
7.1.
Innerhalb von 7 Tagen nach dem Shooting stellt die Fotografin eine Vorauswahl-Galerie („Online-Galerie“) mit leicht korrigierten Bildern bereit (Basis-Licht- und Farbanpassung).
7.2.
Die finale Retusche beginnt erst, nachdem die Eltern ihre Bildauswahl ausschließlich per E-Mail übermittelt haben.
7.3.
Die Standard-Bearbeitungszeit beträgt 7–14 Tage ab dem Eingang der Bildauswahl per E-Mail.
7.4.
Werden zusätzliche Retuschen nach Abschluss des Hauptauftrags bestellt, kann sich die Bearbeitungszeit auf bis zu 21 Tage verlängern.
7.5.
RAW-Dateien werden grundsätzlich nicht herausgegeben.
8. Fristen für die Bildauswahl
8.1.
Die Eltern sind verpflichtet, die finale Bildauswahl innerhalb von 7–14 Kalendertagen nach Bereitstellung der Online-Galerie per E-Mail mitzuteilen. Die konkrete Frist ergibt sich aus Vertrag oder Angebot.
8.2.
Erfolgt keine Rückmeldung innerhalb der Frist, kann die Fotografin:
– die Galerie archivieren und die Bearbeitung pausieren oder
– eine E-Mail-Erinnerung senden und eine zusätzliche Nachfrist von 3 Tagen einräumen.
8.3.
Erfolgt auch danach keine Auswahl, kann die erneute Freischaltung der Galerie oder die Fortsetzung der Bearbeitung nur gegen eine Verwaltungsgebühr (20–50 €, abhängig vom Aufwand) erfolgen.
8.4.
Verzögerungen durch die Eltern verschieben alle Lieferfristen entsprechend; die ursprünglich vereinbarten Lieferzeiten verlieren ihre Gültigkeit.
9. Urheberrecht, Nutzungsrechte und Veröffentlichung
9.1.
Das Urheberrecht an allen Bildern verbleibt vollständig bei der Fotografin.
9.2.
Eltern erhalten ausschließlich die Nutzungsrechte, die im jeweiligen Vertrag ausdrücklich festgelegt sind.
9.3.
Jede weitergehende Nutzung, Veränderung, Filterung, Bearbeitung durch KI, Weitergabe, Verkauf, NFT-Erstellung oder kommerzielle Verwendung ist ohne schriftliche Genehmigung per E-Mail untersagt.
9.4.
Veröffentlichungen auf Social Media, in Chats oder ähnlichen Plattformen sind nur innerhalb der vertraglich gewährten Nutzungsrechte zulässig.
9.5.
Eine Nutzung durch Dritte oder für werbliche Zwecke ist ohne schriftliche Zustimmung strikt untersagt.
10. Datenschutz und Persönlichkeitsrechte des Kindes
10.1.
Die Verarbeitung personenbezogener Daten erfolgt gemäß DSGVO.
10.2.
Bilder von Kindern werden niemals ohne vorherige schriftliche Einwilligung der Erziehungsberechtigten veröffentlicht.
10.3.
Eltern können jederzeit Auskunft über gespeicherte Daten erhalten oder deren Löschung beantragen, sofern dem keine gesetzlichen Aufbewahrungspflichten entgegenstehen.
11. Absage, Terminverschiebung und Abbruch
11.1.
Jede Stornierung oder Terminänderung muss schriftlich per E-Mail erfolgen.
11.2.
Bei Krankheit des Kindes kann der Termin einmal kostenfrei verschoben werden.
11.3.
Bei mehrfachen Verschiebungen oder kurzfristigen Absagen (unter 48 h) können Gebühren gemäß den allgemeinen Stornierungsbedingungen anfallen.
11.4.
Die Fotografin kann das Shooting abbrechen, wenn Sicherheits-, Verhaltens- oder Vertragsregeln verletzt werden. Bereits entstandene Kosten sind vom Kunden zu tragen.
12. Ethische Grenzen der KI-Bearbeitung bei minderjährigen Modellen

Schutz der anatomischen Integrität: Bei der Bearbeitung von Bildmaterial, auf dem minderjährige Personen (unter 18 Jahren) dargestellt sind, verpflichtet sich der Fotograf zur Einhaltung der anatomischen Unveränderlichkeit. Jegliche generative Veränderung der natürlichen Körperproportionen, der Gesichtszüge oder die künstliche Darstellung sekundärer Geschlechtsmerkmale ist untersagt. -
Erlaubte künstlerische Stilisierung: Dieses Verbot erstreckt sich nicht auf dekorative und konzeptionelle Elemente, die die anatomische Echtheit des Modells unberührt lassen. Insbesondere sind folgende KI-gestützte Anpassungen im Rahmen der vereinbarten „Legende“ zulässig:-
Haare: Änderung von Farbe, Länge sowie das Hinzufügen von fantasievollen Frisuren oder Leuchteffekten.

Kleidung und Kostüme: Ergänzung von Details (z. B. Rüstungselemente, Stickereien), Änderung der Stofffarbe oder das Hinzufügen magischer Attribute.

Umgebung und Effekte: Vollständiger oder teilweiser Austausch des Hintergrunds, Hinzufügen von märchenhafter Flora und Fauna (Fabelwesen) sowie atmosphärische Effekte (Licht, Nebel, Magie).

Kosmetische Effekte: Digitales Fantasy-Make-up oder Änderung der Augenfarbe, sofern dies dem künstlerischen Konzept dient.
