Pursuant to §§ 2, 7 UrhG (German Copyright Act), the photographer shall always remain the author of the images.
The German version of this document is the legally binding version. The English translation is provided for convenience and information purposes only
1. Principle
All photographs created by the photographer Ana Lesnaya are protected by copyright in accordance with the German Copyright Act (UrhG, §§ 1–69a UrhG). The photographer remains the sole owner of all copyrights to the images. The customer acquires only the contractually agreed usage rights. Any use, reproduction, transfer, or public publication of the photos without the express written consent of the photographer is prohibited and may be subject to legal action. This policy serves to protect copyrights, ensure compliance with legal regulations, and provide clear rules for usage by customers.
2. Types of usage rights
Supplementary note to Section 2: The conditions set forth in the table above for the categories “Simple/Private Use”, “Commercial Use”, “Exclusive Rights”, and “Reproduction Rights” are a binding part of this policy. In the event of any ambiguities, the table values shall serve as the prevailing definition of the scope of use.
3. Copyright Notices and Acknowledgment

Any publication, exhibition, or online publication must correctly credit the photographer: “Photo: AnaLesnaya (Anastasiia Gorbunova)”.

Omission of the credit constitutes a violation of copyright law and may lead to claims for damages (§ 97 UrhG).

The photographer reserves the right to take legal action in the event of violations.
4. Storage, Archiving, and Security

The photographer archives photos digitally to ensure quality and integrity.

The photographer assumes no responsibility for unauthorized disclosure or storage by the customer outside of the agreed-upon use.

The customer is obligated to protect photos from unauthorized access by third parties.
5. Contract Terms and Duration of Use
Unless otherwise specified in the individual contract, private usage rights are granted for an unlimited period of time. In the case of commercial licenses or exclusive rights, use is limited to the contractually agreed duration.
After this period has expired, any further use must cease, and digital copies must be deleted at the photographer's request.
6. Model Release and Consent
Commercial use, advertising, or publication requires the written consent of the model depicted. For minors, this consent must be provided by the parents or legal guardians. No image may be published or used commercially without a valid consent.
7. Liability
The photographer shall only be liable in cases of gross negligence or intent. Statutory liability for injury to life, body, or health remains unaffected. The customer is liable for any misuse of the photos, particularly in the event of copyright infringements, violations of data protection, or infringement of the personal rights of third parties.
8. Transfer and Sale
The transfer, sale, or licensing of the photos to third parties is prohibited without the express written consent of the photographer. Any unauthorized use will be prosecuted and may lead to claims for damages. This applies in particular to the sale or uploading of photos to stock photography platforms or their use for AI training purposes, both of which are strictly prohibited.
9. Social Media, Portfolio, and Online Use
9.1
The use of the photos on private, non-commercial social media profiles is permitted within the scope of "Private Use."
9.2
In doing so, the photographer must be mandatory credited as the author (e.g., through a link or tagging: “Photo: AnaLesnaya (Anastasiia Gorbunova)”).
9.3
Any editing of the photos (filters, cropping, retouching by third parties) is prohibited unless written permission for "Reproduction" has been granted.
9.4
An express commercial license is required for use on business social media channels (business accounts, advertising).
10. Modifications, Special Agreements, and Additional Rights
Individual agreements regarding usage rights, exclusivity, or publications must be recorded in writing in the contract. Oral agreements are not legally binding. Special rights (e.g., international use, TV broadcasting, advertising campaigns) must be regulated separately.
11. Data Protection and GDPR
Photos contain personal data (likenesses) and are subject to the GDPR (DSGVO). Storage and use take place exclusively within the framework of the contractually agreed rights. The customer may not process or publish the photos in a manner that violates the GDPR or the rights of third parties. For minors, consents from parents or legal guardians must be provided.
12. Practical Notes and Examples

Simple / Private Use: A customer posts their portrait on their private Instagram profile or prints it for their living room.

Commercial Use: A local shop uses the photo for its website or in a printed flyer.

Exclusive Rights: A fashion brand purchases the rights so that no other company may ever use this image.

Reproduction Rights: A magazine receives permission to adjust the photo’s colors to match the layout or to retouch certain elements.
13. Final Provisions
This policy supplements the Photographer's General Terms and Conditions (AGB). Any deviating or supplementary agreements require written confirmation. In the event of conflicts between this policy and the General Terms and Conditions (AGB), the written contractual agreement shall prevail. Severability Clause: Should any provision of this policy be or become invalid, the remaining provisions shall remain unaffected.
Free Downloads / Photo Gifts
The photographer, Anastasiia Gorbunova, is the sole author of all photographs displayed in the "Photo Gifts" section.
Special Terms of Use: The Creative Commons Attribution license (CC BY 4.0) applies exclusively to images published in the "Photo Gifts" section. For all other works created as part of individual assignments (commissioned photoshoots), the standard copyright regulations as defined in my General Terms and Conditions (GTC/AGB) apply.
These photographs may be used, shared, and published for any purpose — including personal, editorial, educational, and commercial use — provided that proper credit is given to the author: “Photo by AnaLesnaya (Anastasiia Gorbunova)”. No additional permission is required. Modification of the images is allowed, provided that the author attribution remains preserved.
Disclaimer:
While these images are free to use under the CC BY 4.0 license, this license refers specifically to the artistic photographs themselves. It does not grant rights to any trademarks, logos, or identifiable persons appearing in the images, nor does it imply endorsement or approval by the photographer.
Important Notice:
The photographer reserves the right to request the removal of attribution (credit) if any modified version of the image contradicts the photographer’s ethical standards or professional reputation.

1. Grundsatz
Alle von der Fotografin Ana Lesnaya erstellten Fotos sind urheberrechtlich geschützt nach dem deutschen Urheberrechtsgesetz (UrhG, §§ 1–69a UrhG).
Die Fotografin bleibt die alleinige Inhaberin aller Urheberrechte an den Bildern. Der Kunde erwirbt lediglich die vertraglich vereinbarten Nutzungsrechte. Jede Nutzung, Vervielfältigung, Weitergabe oder öffentliche Veröffentlichung der Fotos ohne ausdrückliche schriftliche Zustimmung der Fotografin ist untersagt und kann rechtlich verfolgt werden.
Diese Richtlinie dient dem Schutz der Urheberrechte, der Einhaltung gesetzlicher Vorschriften und der klaren Regelung der Nutzung durch Kunden.
2. Arten der Nutzungsrechte
Ergänzender Hinweis zu Punkt 2: Die in der obigen Tabelle aufgeführten Bedingungen für die Kategorien „Einfache/Private Nutzung“, „Kommerzielle Nutzung“, „Exklusive Rechte“ und „Reproduktionsrechte“ sind verbindlicher Bestandteil dieser Richtlinie. Im Falle von Unklarheiten dienen die Tabellenwerte als vorrangige Definition des Nutzungsumfangs.
3. Urheberrechtliche Hinweise und Anerkennung

Jede Veröffentlichung, Ausstellung oder Online-Publikation muss die Fotografin korrekt benennen: „Foto: AnaLesnaya (Anastasiia Gorbunova)“.

Unterlassung der Namensnennung stellt einen Verstoß gegen das Urheberrecht dar und kann Schadensersatzforderungen nach sich ziehen (§ 97 UrhG).

Die Fotografin behält sich vor, bei Verstößen rechtliche Schritte einzuleiten.
4. Speicherung, Archivierung und Sicherheit

Die Fotografin archiviert Fotos digital, um Qualität und Integrität zu sichern.

Die Fotografin übernimmt keine Verantwortung für unbefugte Weitergabe oder Speicherung beim Kunden außerhalb der vereinbarten Nutzung.

Der Kunde ist verpflichtet, Fotos vor unbefugtem Zugriff Dritter zu schützen.
5. Vertragsbedingungen und Nutzungsdauer

Sofern im Einzelvertrag nicht anders angegeben, werden private Nutzungsrechte zeitlich unbegrenzt gewährt.

Bei kommerziellen Lizenzen oder Exklusivrechten ist die Nutzung auf die vertraglich vereinbarte Dauer beschränkt. Nach Ablauf dieser Frist ist jede weitere Nutzung zu unterlassen, und digitale Kopien sind auf Verlangen der Fotografin zu löschen.
6. Model Release und Einwilligung

Kommerzielle Nutzung, Werbung oder Veröffentlichung erfordert die schriftliche Einwilligung des abgebildeten Models.

Für Minderjährige muss diese Einwilligung von den Eltern oder Erziehungsberechtigten erteilt werden.

Ohne gültige Einwilligung darf kein Bild veröffentlicht oder kommerziell genutzt werden.
7. Haftung

Die Fotografin haftet nur bei grober Fahrlässigkeit oder Vorsatz.

Gesetzliche Haftung für Verletzungen von Leben, Körper oder Gesundheit bleibt unberührt.

Der Kunde haftet für jede missbräuchliche Nutzung der Fotos, insbesondere bei Urheberrechtsverstößen, Verletzungen von Datenschutz oder Persönlichkeitsrechten Dritter.
8. Weitergabe und Verkauf

Weitergabe, Verkauf oder Lizenzierung der Fotos an Dritte ist ohne schriftliche Zustimmung der Fotografin verboten.

Jede unautorisierte Nutzung wird rechtlich verfolgt und kann Schadensersatzforderungen nach sich ziehen.

Dies gilt insbesondere für den Verkauf oder das Hochladen auf Stockfoto-Plattformen oder die Nutzung für KI-Trainingszwecke, was strengstens untersagt ist.
9. Social Media, Portfolio und Online-Verwendung
9.1
Die Nutzung der Fotos auf privaten, nicht-kommerziellen Social-Media-Profilen ist im Rahmen der „Privaten Nutzung“ gestattet.
9.2
Dabei ist die Fotografin zwingend als Urheberin zu nennen (z. B. durch Verlinkung oder Tagging: „Foto: AnaLesnaya (Anastasiia Gorbunova)“).
9.3
Jegliche Bearbeitung der Fotos (Filter, Zuschnitte, Retusche durch Dritte) ist untersagt, sofern keine schriftliche Erlaubnis zur „Reproduktion“ vorliegt.
9.4
Für die Nutzung auf geschäftlichen Social-Media-Kanälen (Business-Accounts, Werbung) ist eine ausdrückliche kommerzielle Lizenz erforderlich.
10. Änderungen, Sondervereinbarungen und Zusatzrechte

Individuelle Vereinbarungen zu Nutzungsrechten, Exklusivität oder Veröffentlichungen sind schriftlich im Vertrag festzuhalten.

Mündliche Absprachen sind nicht rechtsverbindlich.

Sonderrechte (z. B. internationale Nutzung, TV-Ausstrahlung, Werbekampagnen) müssen gesondert geregelt werden.
11. Datenschutz und DSGVO

Fotos enthalten personenbezogene Daten (Bildnisse) und unterliegen der DSGVO.

Speicherung und Nutzung erfolgt ausschließlich im Rahmen der vertraglich vereinbarten Rechte.

Der Kunde darf die Fotos nicht in einer Weise verarbeiten oder veröffentlichen, die gegen DSGVO oder Rechte Dritter verstößt.

Für Minderjährige müssen Einwilligungen der Eltern/Erziehungsberechtigten vorliegen.
12. Praktische Hinweise und Beispiele

Einfache / Private Nutzung: Ein Kunde postet sein Portrait auf seinem privaten Instagram-Profil oder druckt es für sein Wohnzimmer aus.

Kommerzielle Nutzung: Ein lokaler Shop nutzt das Foto für seine Website oder in einem gedruckten Flyer.
-
Exklusive Rechte: Eine Modemarke kauft die Rechte, damit kein anderes Unternehmen dieses Bild jemals nutzen darf.

Reproduktionsrechte: Ein Magazin erhält die Erlaubnis, das Foto farblich an das Layout anzupassen oder Elemente zu retuschieren.
13. Schlussbestimmungen

Diese Richtlinie ergänzt die AGB der Fotografin.

Abweichende oder ergänzende Vereinbarungen bedürfen der schriftlichen Bestätigung.
-
Im Falle von Konflikten zwischen dieser Richtlinie und den AGB gilt die schriftliche Vertragsvereinbarung.
-
Salvatorische Klausel: Sollte eine Bestimmung dieser Richtlinie unwirksam sein, bleiben die übrigen Bestimmungen unberührt.
Kostenlose Downloads / Photo Gifts
Die Urheberin aller im Bereich „Photo Gifts“ gezeigten Fotografien ist Anastasiia Gorbunova.
Besondere Nutzungsbedingungen (Lizenz CC BY 4.0) gelten ausschließlich für die im Bereich 'Photo Gifts'veröffentlichten Bilder. Für alle anderen Werke, die im Rahmen von Individualaufträgen (Auftragsshootings) erstellt wurden, gelten die Standardregelungen zum Urheberrecht gemäß meinen AGB.
Diese Fotografien dürfen für jeden Zweck verwendet, geteilt und veröffentlicht werden – einschließlich privater, redaktioneller, edukativer sowie kommerzieller Nutzung –, sofern eine ordnungsgemäße Urheberangabe erfolgt: „Photo by AnaLesnaya (Anastasiia Gorbunova)“. Eine weitere Genehmigung ist не требуется. Bearbeitungen der Bilder sind zulässig, sofern die Urheberangabe erhalten bleibt.
Haftungsausschluss (Disclaimer): Obwohl diese Bilder gemäß der Lizenz CC BY 4.0 frei nutzbar sind, bezieht sich diese Lizenz ausschließlich auf die künstlerischen Fotografien als solche. Sie gewährt keine Rechte an Marken, Logos oder erkennbaren
Personen, die auf den Bildern abgebildet sein könnten, und stellt keine Zustimmung oder Empfehlung durch die Fotografin dar.
