Consent to Image Processing (GDPR)

1. General Principles
1.1.
The processing of personal data (name, email address, communication history, billing data, and image material) is carried out primarily on the basis of Art. 6 (1) (b) GDPR for the performance of the contract (execution of the photoshoot, image editing, invoicing). Additional consent pursuant to Art. 6 (1) (a) GDPR is only required for purposes beyond this, in particular the publication of images for promotional or portfolio purposes, and will be obtained separately.
1.2.
The processing of personal data is carried out exclusively for the purpose of contract fulfillment, customer communication, image editing, provision of the online gallery, and invoicing.
1.3.
Processing is carried out in accordance with the General Terms and Conditions (GTC/AGB) as well as supplementary regulations (Payment and Cancellation Terms, delivery periods, guidelines for child photoshoots, etc.).
2. Image Processing and Storage
2.1.
The Photographer collects, stores, and processes image data (RAW, JPEG, edited files) exclusively for the following purposes: – Execution of the photoshoot – Selection of images by the Customer – Image editing according to the booked package – Provision of the final files.
2.2.
RAW files are generally not released and remain exclusively in the possession of the Photographer.
2.3.
Image data is stored locally and/or on servers of trustworthy, GDPR-compliant service providers.
2.4.
Storage occurs only for as long as necessary for contract fulfillment, archiving, reorders, and to comply with statutory retention obligations.
2.5.
Biometric identification of the person does not take place. The use of AI-supported tools for purely aesthetic image processing and retouching (e.g., Adobe Neural Filters) remains unaffected by this.
3. Use of External Service Providers and WIX Platform
3.1.
The Photographer's website is operated via WIX.com. WIX acts as a data processor pursuant to Art. 28 GDPR. In addition, the privacy policy of WIX applies.
3.2.
WIX stores personal data in data centers within the EU and, where technically necessary, in countries outside the EU. The transfer is carried out on the basis of appropriate safeguards, in particular Standard Contractual Clauses pursuant to Art. 46 GDPR, as well as on the basis of the EU-U.S. Data Privacy Framework.
3.3.
For the technical processing of online galleries, communication, and file transfer, the following third-party providers may be used:
– WIX Media Hosting
– WIX Email/SMTP systems
– Communication services (e.g., WhatsApp Business, Instagram/Meta)
– GDPR-compliant cloud services such as WeTransfer, Pixieset, Dropbox, or comparable providers
3.4.
The Customer acknowledges that the provision of the online gallery is technically impossible without processing by WIX.
3.5.
When visiting the website, technical usage data (IP address, device information, timestamps, cookies) is automatically processed by WIX. This processing is necessary for the operation of the website and is carried out in accordance with WIX's privacy policy.
4. Rights of the Customer (Art. 15–21 GDPR)
The Customer has the following rights at any time:
– Right of access to stored data.
– Right to rectification of incorrect data.
– Right to erasure (Right to be forgotten), provided that no statutory retention obligations conflict with this. Note: The erasure of image material is only possible after full performance of the contract.
– Right to restriction of processing.
– Right to data portability.
– Right to object, in particular against the use for promotional purposes.
– Right to lodge a complaint with the competent data protection supervisory authority.
An objection does not have retroactive effect and does not affect the performance of the contract, provided that it does not make the execution of the booked services impossible.
5. Use of Images (Private Use and Publication)
5.1.
Upon completion of the photoshoot, the Customer receives a simple, non-transferable right of use for private purposes. Commercial use requires a separate written agreement.
5.2.
The use of the images by the Photographer for promotional or portfolio purposes shall only take place upon prior, separate consent.
5.3.
Consent for publication may be revoked at any time. The revocation does not have retroactive effect and does not affect publications that have already been lawfully made.
6. Data Security and Protection
6.1.
The Photographer takes appropriate technical and organizational measures (password protection, secure archiving, encrypted transfer, restricted access rights).
6.2.
WIX implements additional security measures such as HTTPS encryption, firewalls, and protection against DDoS attacks.
6.3.
Absolute protection against external attacks cannot be technically guaranteed.
6.4.
The Customer is responsible for protecting the provided download links against access by unauthorized third parties.
The Photographer shall not be liable for any misuse of data resulting from the improper disclosure or transfer of access links by the Customer.
7. Duration of Storage
7.1
Personal data (such as name and billing address) shall be stored for a period of 10 years in accordance with the statutory retention obligations pursuant to Section 147 of the German Fiscal Code (AO) and Section 257 of the German Commercial Code (HGB).
Image data (RAW files and final images) shall be stored for the duration of processing and delivery. For the purpose of safeguarding the results and enabling potential reorders, the final image data shall be archived by the photographer for a total period of three (3) months.
Upon expiry of this period, the data shall be permanently deleted. There shall be no entitlement to permanent storage or to restoration of the image data after the expiration of this three-month period.
7.2.
Longer storage may be required for:
– copyright and documentary evidence
– tax and commercial retention obligations
– reorders or complaints
– internal archiving
7.3.
There is no claim to indefinite data retention.
8. Withdrawal of Consent
8.1.
Consent to data processing may be revoked at any time in writing via email. Messenger messages do not constitute a valid withdrawal.
8.2.
The withdrawal does not release the Customer from existing contractual obligations (e.g., payment, acceptance of the finished images).
8.3.
Upon completion of all contractual obligations, data will be deleted, provided that no statutory retention obligations exist.

10. Validity and Precedence of GTC
10.1.
These data protection and consent regulations supplement the General Terms and Conditions (GTC/AGB) as well as all other policies of the Photographer.
10.2.
In the event of discrepancies, the GTC/AGB shall prevail, provided they are compatible with the GDPR.

1. Allgemeine Grundlagen
1.1.
Die Verarbeitung personenbezogener Daten (Name, E-Mail-Adresse, Kommunikationsverlauf, Rechnungsdaten sowie Bildmaterial) erfolgt primär auf Grundlage von Art. 6 Abs. 1 lit. b DSGVO zur Erfüllung des Vertrages (Durchführung des Shootings, Bildbearbeitung, Rechnungsstellung). Eine zusätzliche Einwilligung nach Art. 6 Abs. 1 lit. a DSGVO ist nur für darüber hinausgehende Zwecke, insbesondere die Veröffentlichung von Bildern zu Werbe- oder Portfoliozwecken, erforderlich und wird gesondert eingeholt.
1.2.
Die Verarbeitung personenbezogener Daten erfolgt ausschließlich zum Zweck der Vertragserfüllung, Kundenkommunikation, Bildbearbeitung, Bereitstellung der Online-Galerie und Rechnungsstellung.
1.3.
Die Verarbeitung erfolgt im Einklang mit den AGB sowie ergänzenden Regelungen (Zahlungs- und Stornierungsbedingungen, Lieferfristen, Richtlinien für Kindershootings etc.).
2. Bildverarbeitung und Speicherung
2.1.
Die Fotografin erhebt, speichert und verarbeitet Bilddaten (RAW, JPEG, bearbeitete Dateien) ausschließlich für folgende Zwecke:
– Durchführung des Fotoshootings
– Auswahl der Bilder durch die Kundin/den Kunden
– Bildbearbeitung gemäß gebuchtem Paket
– Bereitstellung der finalen Dateien
2.2.
RAW-Dateien werden grundsätzlich nicht herausgegeben und verbleiben ausschließlich im Besitz der Fotografin.
2.3.
Bilddaten werden lokal und/oder auf Servern vertrauenswürdiger, DSGVO-konformer Dienstleister gespeichert.
2.4.
Die Speicherung erfolgt nur so lange, wie dies für die Vertragserfüllung, Archivierung, Nachbestellungen sowie zur Erfüllung gesetzlicher Aufbewahrungspflichten erforderlich ist.
2.5.
Eine biometrische Identifizierung der Person findet nicht statt. Der Einsatz von KI-gestützten Werkzeugen zur rein ästhetischen Bildbearbeitung und Retusche (z. B. Adobe Neural Filters) bleibt hiervon unberührt.
3. Nutzung externer Dienstleister und WIX-Plattform
3.1.
Die Website der Fotografin wird über WIX.com betrieben. WIX agiert als Auftragsverarbeiter gemäß Art. 28 DSGVO. Zusätzlich gelten die Datenschutzbestimmungen von WIX.
3.2.
WIX speichert personenbezogene Daten in Rechenzentren innerhalb der EU sowie – falls technisch erforderlich – in Ländern außerhalb der EU. Die Übermittlung erfolgt auf Grundlage geeigneter Garantien, insbesondere Standardvertragsklauseln gemäß Art. 46 DSGVO sowie auf Grundlage des EU-U.S. Data Privacy **Frameworks**.
3.3.
Für die technische Abwicklung der Online-Galerien, Kommunikation und Dateiübertragung können folgende Drittanbieter eingesetzt werden:
– WIX Media Hosting
– WIX E-Mail-/SMTP-Systeme
– Kommunikationsdienste (z. B. WhatsApp Business, Instagram/Meta)
– DSGVO-konforme Cloud-Dienste wie WeTransfer, Pixieset, Dropbox oder vergleichbare Anbieter
3.4.
Die Kundin/der Kunde nimmt zur Kenntnis, dass die Bereitstellung der Online-Galerie ohne die Verarbeitung durch WIX technisch nicht möglich ist.
3.5.
Beim Besuch der Website werden durch WIX automatisch technische Nutzungsdaten verarbeitet (IP-Adresse, Geräteinformationen, Zeitstempel, Cookies). Diese Verarbeitung ist für den Betrieb der Website notwendig und erfolgt gemäß den Datenschutzbestimmungen von WIX.
4. Rechte der Kundin/des Kunden (Art. 15–21 DSGVO)
Die Kundin/der Kunde hat jederzeit folgende Rechte:
– Auskunft über gespeicherte Daten
– Berichtigung unrichtiger Daten
– Löschung, sofern keine gesetzlichen Aufbewahrungspflichten entgegenstehen
Hinweis: Eine Löschung von Bildmaterial ist erst nach vollständiger Vertragserfüllung möglich.
– Einschränkung der Verarbeitung
– Datenübertragbarkeit
– Widerspruch, insbesondere gegen die Nutzung zu Werbezwecken
– Beschwerderecht bei der zuständigen Datenschutzaufsichtsbehörde
Ein Widerspruch wirkt nicht rückwirkend und berührt die Vertragserfüllung nicht, sofern er die Ausführung der gebuchten Leistungen nicht unmöglich macht.
5. Verwendung der Bilder (private Nutzung und Veröffentlichungen)
5.1.
Mit Abschluss des Shootings erhält die Kundin/der Kunde ein einfaches, nicht übertragbares Nutzungsrecht für private Zwecke. Eine kommerzielle Nutzung erfordert eine gesonderte schriftliche Vereinbarung.
5.2.
Eine Nutzung der Bilder durch die Fotografin zu Werbe- oder Portfoliozwecken erfolgt ausschließlich nach vorheriger, gesonderter Zustimmung.
5.3.
Die Einwilligung zur Veröffentlichung kann jederzeit widerrufen werden. Der Widerruf wirkt nicht rückwirkend und betrifft nicht bereits rechtmäßig erfolgte Veröffentlichungen.
6. Sicherheit und Schutz der Daten
6.1.
Die Fotografin trifft angemessene technische und organisatorische Maßnahmen (Passwortschutz, gesicherte Archivierung, verschlüsselte Übertragung, beschränkte Zugriffsrechte).
6.2.
WIX setzt zusätzliche Sicherheitsmaßnahmen wie HTTPS-Verschlüsselung, Firewall und Schutz vor DDoS-Angriffen ein.
6.3.
Ein absoluter Schutz vor externen Angriffen kann technisch nicht garantiert werden.
6.4.
Die Kundin/der Kunde ist verantwortlich für den Schutz der zur Verfügung gestellten Download-Links vor dem Zugriff unbefugter Dritter. Die Fotografin haftet nicht für einen Missbrauch der Daten, der durch eine unsachgemäße Weitergabe der Zugangslinks durch die Kundin/den Kunden entsteht.
7. Dauer der Speicherung
7.1.
Personenbezogene Daten (wie Name und Rechnungsanschrift) werden gemäß den gesetzlichen Aufbewahrungspflichten (§ 147 AO, § 257 HGB) für 10 Jahre gespeichert. Bilddaten (RAW, fertige Bilder) werden für die Dauer der Bearbeitung und Bereitstellung gespeichert. Zur Sicherung der Ergebnisse und für mögliche Nachbestellungen werden die finalen Bilddaten für insgesamt 3 Monate im Archiv der Fotografin gespeichert. Nach Ablauf dieser Frist erfolgt die endgültige Löschung. Ein Anspruch auf eine dauerhafte Speicherung oder Wiederherstellung nach Ablauf dieser 3 Monate besteht nicht.
7.2.
Eine längere Speicherung kann erforderlich sein für:
– urheberrechtliche und dokumentarische Nachweise
– steuerliche und handelsrechtliche Aufbewahrungspflichten
– Nachbestellungen oder Reklamationen
– interne Archivierung
7.3.
Ein Anspruch auf unbegrenzte Datenaufbewahrung besteht nicht.
8. Widerruf der Einwilligung
8.1.
Die Einwilligung zur Datenverarbeitung kann jederzeit schriftlich per E-Mail widerrufen werden. Messenger-Nachrichten gelten nicht als wirksamer Widerruf.
8.2.
Der Widerruf entbindet nicht von bestehenden vertraglichen Pflichten (z. B. Zahlung, Abnahme der fertigen Bilder).
8.3.
Nach Abschluss aller vertraglichen Pflichten werden Daten gelöscht, sofern keine gesetzlichen Aufbewahrungspflichten bestehen.

10. Geltung und Vorrang der AGB
10.1.
Diese Datenschutz- und Einwilligungsregelungen ergänzen die AGB sowie alle weiteren Richtlinien der Fotografin.
10.2.
Bei Abweichungen gelten die AGB, sofern sie mit der DSGVO vereinbar sind.
